1. Introduction
Volentas LLC ("Volentas," "we," "us," or "our") respects the privacy of visitors to the website located at volentas.com, including its subdomains (collectively, the "Site"). This Privacy Policy (this "Policy") describes the personal information we collect through the Site, the purposes for which we use it, the circumstances under which we disclose it, how long we retain it, and the rights and choices available to you. "Personal information" means information that identifies, relates to, or could reasonably be linked with a particular individual or household.
This Policy applies solely to the Site. It does not apply to information that Volentas processes on behalf of its clients in the performance of professional services, which is governed by the agreement for those services, or to information collected offline or through channels that do not link to this Policy.
By accessing or using the Site, you acknowledge that you have read and understood this Policy. If you do not agree with this Policy, do not use the Site.
2. Information We Collect
2.1 Information You Provide
We collect personal information that you voluntarily provide when you submit an inquiry through the Site or otherwise correspond with us. The information collected through the contact form consists of your name, email address, organization (if provided), and the content of your message. You are not required to provide personal information to browse the Site; however, we cannot respond to an inquiry without it. If you elect to have the results of an interactive feature emailed to you, the email address you provide is used solely to send that one message and is not stored.
2.2 Information Collected Automatically
When you access the Site, our hosting provider automatically records certain information transmitted by your browser or device, including your Internet Protocol ("IP") address, browser type and version, operating system, referring web page, pages viewed, and the date and time of each request ("Log Data"). We also record the IP address from which a contact form submission originates. Log Data is used to secure and administer the Site and is not combined with the information described in Section 2.1 except as necessary to investigate abuse.
We use Cloudflare Web Analytics, a traffic measurement service operated by Cloudflare, to understand how the Site is used in the aggregate. A script loaded with each page reports to Cloudflare the address of the page viewed, the referring page, the type of browser and device, the country from which the request originates, and page load timing. The service operates without cookies or browser storage, and the information is made available to us in aggregated form. Cloudflare's processing of that information is described in Cloudflare's privacy policy.
When you start, complete, or share an interactive feature of the Site, the Site records the name of that feature and the type of event. We use these records in aggregate to understand which features of the Site are used.
The contact form and the form that emails assessment results are protected by an automated challenge operated by our hosting provider, Cloudflare, Inc. ("Cloudflare"), which evaluates browser and network signals to distinguish human visitors from automated traffic. Cloudflare also operates a script on each page as part of its protection of the Site against automated traffic. Cloudflare's processing of that information is described in Cloudflare's privacy policy.
2.3 Information Stored on Your Device
Certain interactive features of the Site store your selections in your browser's local storage so that they persist between visits. If you elect to save or share results generated by such a feature, the numerical results are stored on our systems under a randomly generated reference code and are accessible to any person who holds that code or the resulting link. Where a feature generates narrative text from your results, the numerical results are transmitted to a text-generation service operated by Cloudflare for that purpose.
3. Cookies and Similar Technologies
The public pages of the Site do not set cookies of their own. Cloudflare may set cookies in connection with the automated challenge described in Section 2.2 and its protection of the Site against malicious traffic. The content management area of the Site sets session cookies for authenticated editors. The Site uses browser local storage as described in Section 2.3, to record your display preference, and to record that you have dismissed the cookie notice. You may clear local storage through your browser settings at any time.
The Site does not engage in tracking across third-party websites and does not sell or share personal information. Accordingly, the Site does not alter its behaviour in response to browser "Do Not Track" or Global Privacy Control signals.
4. How We Use Personal Information
We use personal information for the following purposes:
- To respond to your inquiries and to communicate with you regarding our services;
- To operate, maintain, secure, and improve the Site, including the detection and prevention of fraud, abuse, and unauthorized access;
- To comply with applicable law, regulation, legal process, or governmental request; and
- To establish, exercise, or defend legal claims.
Where the data protection laws of the European Economic Area, the United Kingdom, or Switzerland apply, we process personal information on the following legal bases: our legitimate interests in responding to inquiries and in operating and securing the Site; steps taken at your request prior to entering into a contract; your consent, where you elect to save or share results as described in Section 2.3; and compliance with legal obligations.
5. Disclosure of Personal Information
We do not sell personal information, and we do not share personal information for cross-context behavioral advertising, as those terms are defined under applicable law. We disclose personal information only as follows:
Service providers. We engage third parties to perform services on our behalf and under our instructions, including website hosting, data storage, email delivery, and security. These service providers are Cloudflare, Inc., which hosts the Site and stores contact submissions, saved results, and Log Data; and Google LLC, whose Google Workspace service hosts the mailbox to which contact submissions and correspondence are delivered. Each is contractually restricted from using personal information for any purpose other than providing services to us.
Successors in interest. We may disclose personal information to a successor in interest in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets, subject to the commitments in this Policy.
Legal requirements and protection of rights. We may disclose personal information where we believe in good faith that disclosure is required by law, regulation, subpoena, court order, or other legal process, or is necessary to protect the rights, property, or safety of Volentas, our clients, or others.
We do not otherwise disclose personal information to unaffiliated third parties.
6. Retention
We retain personal information for no longer than is necessary for the purposes set out in this Policy, unless a longer period is required or permitted by law. Contact form submissions are retained for twenty-four (24) months from the date of receipt, and the IP address associated with a submission is deleted after thirty (30) days. Saved results described in Section 2.3 are retained for twelve (12) months. Log Data is retained by our hosting provider for seven (7) days. Deletion in accordance with these periods is performed automatically. Correspondence conducted by email is retained in the ordinary course of business for as long as reasonably necessary to administer our relationship with you and to satisfy our legal and record-keeping obligations.
7. Security
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure, including transport-layer encryption for all connections to the Site, encryption of stored data, and access controls restricting stored personal information to authorized personnel. No method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. We are not responsible for the security of information you transmit to us over networks that we do not control.
8. Your Rights and Choices
Depending on your jurisdiction, you may have the right to request access to the personal information we hold about you; to request that we correct inaccurate personal information; to request that we delete personal information; to receive a copy of personal information you have provided to us in a portable format; to object to or request restriction of certain processing; and to withdraw consent where our processing is based on consent, without affecting the lawfulness of processing prior to withdrawal. We will not discriminate against you for exercising any of these rights.
Residents of California and other U.S. states. If you are a resident of California, Colorado, Connecticut, Texas, Utah, Virginia, or another state that has enacted a comprehensive consumer privacy law, you may exercise the rights described above to the extent provided by the law of your state. Because we do not sell personal information, share it for targeted advertising, or engage in profiling that produces legal or similarly significant effects, no opt-out right in respect of those activities is applicable. We have not sold or shared personal information in the preceding twelve (12) months.
Exercising your rights. To submit a request, contact us at the address set out in Section 12. We may require you to provide sufficient information to verify your identity and to locate the information at issue. An authorized agent may submit a request on your behalf upon presentation of your signed permission. We will respond within forty-five (45) days of receipt of a verifiable request, or within such other period as applicable law requires, and will notify you if an extension is necessary. If we decline to act on a request, we will state the reason, and you may appeal our decision by replying to our response; we will respond to an appeal within sixty (60) days and, where applicable, provide the means by which you may contact your state attorney general. Nothing in this Section requires us to delete information that we are required to retain for legal, administrative, or security purposes.
Residents of the European Economic Area, the United Kingdom, and Switzerland. In addition to the rights described above, you have the right to lodge a complaint with the supervisory authority in your jurisdiction. Volentas is established in the United States, and personal information you provide is transferred to and processed in the United States, where data protection laws may differ from those of your jurisdiction. Our service providers process personal information under contractual safeguards, including standard contractual clauses where required.
9. Children's Privacy
The Site is directed to professionals and is not intended for children under the age of sixteen (16). We do not knowingly collect personal information from children. If we learn that we have collected personal information from a child without verification of parental consent, we will delete that information. If you believe that a child has provided personal information to us, contact us at the address set out in Section 12.
10. Third-Party Websites
The Site contains links to websites operated by third parties. We do not control, and are not responsible for, the content or privacy practices of those websites, and this Policy does not apply to them. We do not endorse or make any representation regarding any third-party website or its content.
11. Changes to This Policy
We reserve the right to modify this Policy at any time. Changes will be effective upon posting of the revised Policy on the Site with a revised effective date, except that material changes affecting personal information previously collected will not take effect until a reasonable period after posting. Your continued use of the Site after the effective date of a revised Policy constitutes your acceptance of it.
